There are a variety of standards to meet to obtain an expunction

Expunging records means wiping the slate clean of any past charges, and Chapter 55 of Texas’ Code of Criminal Procedure allows for the expungement of criminal records under certain circumstances. Criminal charges for both state and federal crimes affect your reputation when applying for a job, seeking a volunteer position, applying for military service or running for political office.

Rather than allowing these black marks to stay on your record, you can work with a San Antonio criminal defense lawyer to have them removed. To obtain an expunction, you must meet certain eligibility standards:

  • The charges against you resulted in a not guilty verdict
  • There was never a court filing after your arrest, or the court dismissed your case
  • Your offense was underage drinking and you are now at least 21 years old
  • Your offense was a juvenile offense, you went through the juvenile court process and you fulfilled all of the necessary time obligations before petitioning the court for expungement

Expungement for juvenile records is not simple. Unfortunately, courts do not simply clear your records after a certain amount of time, or after you legally become an adult. A certain amount of time must pass for you to file for an expunction, and you must follow certain processes that you must follow to petition the court for expungement.
